According to a particular interpretation of quantum mechanics, the causal role of human consciousness in the measuring process is called upon to solve a foundational problem called the “measurement problem.” Traditionally, this interpretation is tied up with the metaphysics of substance dualism. As such, this interpretation of quantum mechanics inherits the dualist’s mind-body problem. Our working hypothesis is that a process-based approach to the consciousness causes collapse interpretation (CCCI) ---leaning on Whitehead’s solution to the mind-body problem--- offers a better metaphysical (...) understanding of consciousness and its role in interpreting quantum mechanics. The article presents probable impacts from COVID-19 on 5 components of the food system: social organizations; markets; science and technology; nature (biophysical environment); and public policies. It investigates which proposals contained in the State Plan for Food and Nutritional Security of the State of São Paulo (PLANSAN-SP) can respond to these impacts, mitigating them. The impacts of COVID-19 on food systems are broad and profound, considering the different realities raised by bibliographic research. These impacts directly affect the food consumption of (...) the population from the quarantine dynamics adopted worldwide, in various forms, with negative effects on access and availability of food in the short, medium and long terms. PLANSAN-SP contains several proposals to guarantee the Human Right to Adequate Food (DHAA) and to stimulate Food Sovereignty and Food Nutrition and Security (SAN). The article considers that the dialogue between the organized civil society and the public power is fundamental for the construction of proposals adjusted to a diversity of challenges and realities present in the State of São Paulo. It considers also that PLANSAN-SP, if implemented and monitored could respond positively to the impacts of COVID -19 in the São Paulo food system. (shrink)

In romantic relationships, individual differences are determinant factors for relational quality. Specifically, romantic attachment and difficulties in emotional regulation influence each other and may have predictive potential for the perceived dyadic adjustment level. This paper aims to identify the developmental parallel between behavioral patterns built since childhood and the construction of the emotional regulation skills that characterize them. Our analysis was based on the attachment theory and the concepts of romantic relationship and DA. In this way, we sought to further (...) the understanding of relationship dynamics, beyond the usual focus on a single element and on associative relationships, and by exploring other effects among the different dimensions of relational functioning. In particular, we explored the predictive ability of emotional regulation patterns in discriminating between RA styles, and their impact on the quality of romantic relationships, in the anticipation of dyadic adjustment variations. A expressão “o Messias sou eu” aplica-se à relação ética como primeiro acontecer do messias. Subjetividade mesma do sujeito. Através de comentários rabínicos do Talmude, Lévinas traz uma hermenêutica que faz recurso à ética como proximidade e responsabilidade inalienável e insubstituível por outrem. Nesse sentido, as noções hebraicas de messianismo e dizer profético , lidas no midraxe da hermenêutica rabínica, permitem avançar na ideia da linguagem religiosa em seu sentido original: ética. Tais noções habitam uma ordem metafórica que permite ao (...) pensamento desdizer-se e a querer dizer outramente. Nos comentários do Talmude não há lugar para o entusiasmo religioso ou para o arrebatamento de uma experiência mística, mas hermenêutica rigorosa e ininterrupta à procura de sentido que está sempre mais além. Tal maneira de ler a experiência religiosa abandona o sagrado numinoso para se chegar à transcendência como ética. Trata-se do pensamento marcado pela experiência do homem refém de todos os outros. Esse homem é necessário aos outros homens, visto que, sem ele, a moral não começaria em parte alguma. É homem messiânico contemporâneo, eleito e profético. Em Lévinas, o Messias sou eu . Palavras-chave : Hermenêutica. Religião. Ética. Messias.The expression "I am the messiah" applies to the ethical relationship as the first task of the messiah: the subjectivity of the own subject. Through rabbinic commentaries from the Talmud, Levinas brings us a hermeneutic that understands ethics as proximity and responsibility, irreplaceable and inalienable by others. In this sense, the Hebrew notions of messianism and prophetic words, taken from the midrash within the rabbinic hermeneutics, allow us to advance on the idea of religious language in its original sense: ethics. Such notions are metaphors that take the thought to reveal itself in other ways. In the comments of the Talmud there is no place for religious enthusiasm or for any sort of rapture of mystical nature. But, there is indeed, a place for a rigorous hermeneutic that it is in permanent search for a kind of meaning that is always beyond. This way of understanding the religious experience leaves the sacred numinous and understands transcendence as ethics. In this sense the thought appears marked by the experience of the man who is seen as hostage to each other. This man is necessary to the other man, since without him the moral would never start anywhere. Within Levinas perspective, ‘I am’ this contemporary and elected messiah. Keywords : Hermeneutic. Este trabalho tem como objetivo destacar a construção híbrida do romance de formação O fazedor de Velhos (2008) de Rodrigo Lacerda. Dessa forma pretende-se discutir os valores e a manutenção da literatura brasileira para jovens, verificando de qual forma esses valores estão representados no romance de formação, considerando as peculiaridades do gênero. Para tanto, serão analisados em específico os aspectos estruturais da narrativa, tendo como foco a passagem de tempo na constituição da personagem, por um viés intertextual com a literatura (...) universal. Teachers in medical ethics, however, more often focus on the cognitive and rational ethical aspects and not much on students’ emotions. The purpose of this qualitative study was to explore students’ feelings and emotions when dealing with ethical problems during their clinical training and explore differences between two countries: Indonesia and the Netherlands. We observed a total (...) of eighteen ethics group discussions and interviewed fifteen medical students at two medical schools. Data were interpreted and analyzed using content analysis. We categorized students’ negative emotions based on their objects of reflection and came up with three categories: emotions concerning their own performance, emotions when witnessing unethical behaviors, and emotions related to barriers and limitations of their working environment. Our study suggests that addressing emotional responses in a culturally sensitive way is important to develop students’ self-awareness. Teachers should be able to guide students to reflect on and be critical of their own thoughts and emotions, to understand their own moral values, especially when confronted with other individuals. A sizeable body of literature suggests that informal methods of dispute resolution — and, in particular, conciliation — flourish only in societies marked by extensive social hierarchy. Given this literature, it is quite surprising to discover that in the mid-nineteenth century, the United States embarked on an extensive debate regarding whether to adopt "conciliation courts," whose primary function was to reconcile the disputants by persuading them to embrace an equitable compromise. First created by the French Revolutionaries in 1790, conciliation courts (...) were widely established throughout continental Europe. Observing this development, leading American lawyers and politicians pondered seriously whether the United states ought to follow suit. Debate over whether to embrace such institutions occurred at the very highest of levels, and a series of states enacted constitutional provisions authorizing their legislatures to create conciliation courts. Ultimately, however, despite the widespread interest in such institutions, these were never established — except in the notable case of the Freedmen’s Bureau courts of the Reconstruction South. This Article explores this largely forgotten episode in American legal history. It examines why a nation that was radically egalitarian by standards of the time would seriously consider embracing an institution that we tend more commonly to associate with inegalitarian, strongly hierarchical societies — and why, after coming so close to adopting conciliation courts, it ultimately failed to do so. In the process, by situating the debate over conciliation courts in a broader social and legal context, the Article also excavates the origins of the modern, quintessentially American commitment to the virtues of formal, adversarial process. O presente artigo apresenta um relato de experiência das ações extensionistas promovidas no ano de 2021 pelo Núcleo de Estudos Afro-brasileiros e Indígenas (NEABI) do Campus Ibirama da Instituto Federal Catarinense. Devido ao contexto de pandemia de COVID-19, que perdurou durante quase todo o ano letivo de 2021, as atividades do Núcleo precisaram ser adaptadas para que ocorressem em ambientes virtuais. Apesar desta adequação forçada, que limitou em grande medida a diversidade das ações, foi possível identificar tanto o promissor potencial (...) do NEABI quanto os desafios a serem superados para que a temática étnico-racial seja definitivamente incluída nos espaços institucionais e passe a fazer parte do cotidiano da comunidade escolar. It is becoming increasingly clear that repetitive DNA is of biological significance as well as experimental importance. Here we review the information available about one type of repetitive DNA, the trinucleotide repeat (CAC)n, and briefly compare it with other trinucleotide repeats. Although much work has been done in analysing DNA fingerprinting patterns produced using the synthetic oligonucleotide (CAC)5 as a probe, there is relatively little information about individual (CAC)n‐containing sequences and their abundance, organisation and distribution in mammalian DNA. From the (...) data that is available, it is clear that there are at least two areas that should repay further study: (1) the organisation and generation of long sequences that contain (CAC)n motifs as part of a larger repeating unit (minisatellites) and (2) the distribution of small (CAC)n sequences (microsatellites), in particular their relationship to genes. Companies that are serious about corporate governance and business ethics are turning their attention to gender diversity at the most senior levels of business . Board gender diversity has been the subject of several studies carried out by international organizations such as Catalyst , the World Economic Forum , and the European Board Diversity Analysis . They all lead to reports confirming the overall relatively low proportion of women on boards and the slow pace at which more women are being (...) appointed. Furthermore, the proportion of women on corporate boards varies much across countries. Based on institutional theory, this study hypothesizes and tests whether this variation can be attributed to differences in cultural settings across countries. Our analysis of the representation of women on boards for 32 countries during 2010 reveals that two cultural characteristics are indeed associated with the observed differences. We use the cultural dimensions proposed by Hofstede to measure this construct. Results show that countries which have the greatest tolerance for inequalities in the distribution of power and those that tend to value the role of men generally exhibit lower representations of women on boards. The aim of this essay is to develop a coherence theory for the justification of evidentiary judgments in law. The main claim of the coherence theory proposed in this article is that a belief about the events being litigated is justified if and only if it is a belief that an epistemically responsible fact finder might hold by virtue of its coherence in like circumstances. The article argues that this coherentist approach to evidence and legal proof has the resources to (...) meet some of the main objections that may be addressed against attempts to analyze the justification of evidentiary judgments in law in coherentist terms. It concludes by exploring some implications of the proposed version of legal coherentism for a jurisprudence of evidence. (shrink)

Este trabajo estudia algunas colecciones de documentos notariales árabes que se han conservado en Granada, desde el punto de vista de la mentalidad de archivo. Está especialmente enfocado al análisis de cómo y por qué sobrevivieron estos documentos y quién pudo pensar que se trataba de un material que merecía ser preservado. Este estudio contribuye a conocer mejor el comportamiento de los habitantes de Granada hacia los documentos árabes.

Stigma against mental disability within the medical field continues to impose significant barriers on physicians and trainees. Here, we examine several implications of this stigma and propose steps toward greater inclusion of persons with mental disabilities in the physician workforce.

In recent years coherence theories of law and adjudication have been extremely influential in legal scholarship. These theories significantly advance the case for coherentism in law. Nonetheless, there remain a number of problems in the coherence theory in law. This ambitious new work makes the first concerted attempt to develop a coherence-based theory of legal reasoning, and in so doing addresses, or at least mitigates these problems. The book is organized in three parts. The first part provides a critical analysis (...) of the main coherentist approaches to both normative and factual reasoning in law. The second part investigates the coherence theory in a number of fields that are relevant to law: coherence theories of epistemic justification, coherentist approaches to belief revision and theory-choice in science, coherence theories of practical and moral reasoning and coherence-based approaches to discourse interpretation. Taking this interdisciplinary analysis as a starting point, the third part develops a coherence-based model of legal reasoning. While this model builds upon the standard theory of legal reasoning, it also leads to rethinking some of the basic assumptions that characterize this theory, and suggests some lines along which it may be further developed. Thus, ultimately, the book not only improves upon the current state of coherence theory in law, but also contributes to the larger debate about how to articulate a theory of legal reasoning that results in better decision-making. Peirce’s category of Firstness is first and fundamental. Without Firstness, we can say, nothing can (later) be – no time, no space, no things, no processes, no growth, no regularities, and no thoughts – hence, nothing of which we can ever conceive. However, despite the fundamentality of Peirce’s category of Firstness, we still do not believe that it has received the attention that it rightly deserves; not by Peirce himself, nor by his commentators. In the following we will, therefore, look (...) at the category of Firstness and try to give a modest glimpse of its fundamentality in relation to four other of Peirce’s central concepts: namely, evolution, consciousness, icon, and, finally, abduction. Charles Peirce provided a few, but interesting we believe, remarks about metaphor. Aristotle on the other hand developed a theory of metaphor that, to this day has been, and still is, influential (even though his theory, especially within recent years, also has been heavily criticized, e.g., by Lakoff, George & Mark Johnson. 1980. Metaphors we live by. Chicago: Chicago University Press). Factor, Lance R. 1996. Peirce’s definition of metaphor and its consequences. In Vincent Colapietro & Thomas Olshewsky (eds.), Peirce’s doctrine (...) of signs: Theory, applications, and connections, 229–235. Berlin/new York: Mouton De Gruyter, as one of very few scholars, makes a comparison between Peirce and Aristotle. Factor claims that Peirce’s definition of metaphor and its consequences undermine and overturn Aristotle’s theory. We do not believe that Factor is right; and this is due to Factor’s misinterpretation of key elements within Aristotle’s theory. We rather believe that Peirce and Aristotle, in fact, have central ideas in common concerning metaphor; perhaps, in particular, when it comes to the function of metaphor. Hence, both see, for example, metaphor as a cognitive mechanism. The article tries to develop this argument. (shrink)

Para ello, se ha combinado el estudio bibliométrico con técnicas de análisis de redes sociales a través de los softwares Rstudio y Vosviewer. This essay is devoted to Albert the Great’s theoretical treatment of fatherhood and motherhood, male and female genders, in the generation of the vegetabilia. While animals reproduce by the mating of female and male individuals, plants do not display a sexual distinction through a male and female configuration. Moreover, in the generation of plants, the maternal and paternal functions are not performed by individuals of the same species as what is generated. To fulfill the generative process, plants require the external (...) agency of the Sun and the ground, traditionally deemed as “pater et mater plantarum”. The question of the generation of plants is dealt with at length in Albert’s De vegetabilibus et plantis, where he gives an extensive treatment of plants’ life modeled after the epistemology of Aristotle’s works on animals. This theoretical approach is not confined to Albert’s natural philosophical works but extends also to his theological investigation. By adopting an interdisciplinary standpoint, this essay will show how Albert progressively develops an explicative model for plants generation that, through the comparison with animal generation, aims at identifying the respective domains of matter and form, fatherhood and motherhood, male and female genders, also in the generation of plants. Previous studies show that medical students in clinical training face ethical problems that are not often discussed in the literature. In order to make teaching timely and relevant for them, it is important to understand what medical students perceive as ethical problems, as various factors may influence their perception, including cultural differences and working environment. The purpose of this qualitative study was to explore students’ perceptions of what an ethical problem is, during their clinical training in the hospital, and compare (...) the results from two different countries. We observed a total of eighteen ethics group discussions and interviewed fifteen medical students at two medical schools, in Indonesia and the Netherlands. Data were interpreted and analyzed using content analysis. We found that students in both settings encounter problems which are closer to their daily work and responsibilities as medical students and perceive these problems as ethical problems. Indonesian students perceived substandard care and inequity in healthcare as ethical problems, while Dutch students perceived that cases which are not matters of life and death are less worthy to discuss. Our study suggests that there might be a gap between ethical problems that are discussed in class with teachers, and problems that students actually encounter in practice. Teachers should be aware of the everyday situations in clinical training which may be perceived by students as ethically problematic and should acknowledge and discuss these ethical problems with students as part of the learning processes in ethics education. What is the role and value of virtue, emotion and imagination in law and legal reasoning? These new essays, by leading scholars of both law and philosophy, offer striking and exploratory answers to this neglected question. The collection takes a holistic approach, inquiring as to the connections and relations between virtue, emotion and imagination. In addition to the principal focus on adjudication, essays in the collection also engage with a variety of different legal, political and moral contexts: eg criminal law (...) sentencing, the Black Lives Matter movement and professional ethics. A number of different areas of the law are addressed and the issues explored include: the benefits and limits of empathy in legal reasoning; the role of attention and perception in judicial reasoning;, the identification of judicial virtues and judicial vices ; the values and dangers of certain imaginative devices ; and the interactive and social dimensions of virtue, emotion and imagination. In the 13th century, the availability of Aristotle’s treatises of natural philosophy encouraged forms of integration between libri naturales and sapientia biblica. Instead of diving into allegory and symbolism, several Dominican exegetes began to explore more realistic approaches. The foremost figure is Albert the Great. In his biblical commentaries, philosophy of nature and theology join forces as complementary forms of knowledge. By focusing on Albert’s De vegetabilibus, this paper is aimed at analyzing in which ways the Dominican master reuses his (...) naturalistic and, especially, botanical knowledge as an exegetical tool to deepen both the historical and the allegorical sense, realism and spiritual interpretation. This paper examines the concept of coherence and its role in legal reasoning. First, it identifies some problem areas confronting coherence theories of legal reasoning about both disputed questions of fact and disputed questions of law. Second, with a view to solving these problems, it proposes a coherence model of legal reasoning. The main tenet of this coherence model is that a belief about the law and the facts under dispute is justified if it is “optimally coherent,” that is, if (...) it is such that an epistemically responsible legal decision-maker would have accepted it as justified by virtue of its coherence in like circumstances. Last, looking beyond the coherence theory, the paper explores the implications of the version of legal coherentism proposed for a general theory of legal reasoning and rationality. (shrink)

A tentativa é mostrar que o conceito de autonomia poderá ser construído de acordo com a teoria da Liberdade em Jean Paul Sartre e o conceito de Prática Pedagógica a partir dos princípios e saberes apresentados por Paulo Freire. Assim, será possível analisar a Prática Pedagógica à luz do conceito de Autonomia.

This article deals with public manifestations of Catholic religious officials, members of the hierarchy and recognized laity, in the context of the discussion of the National Education Plan - PNE. The focus of the analysis is a condemnation of what they call "gender ideology", present in the proposal document. Such manifestations are the reaffirmation of a conception of human beings as subject to the inexorable "laws of nature" that determine a social order marked by the rigid distinction of roles assigned (...) to women and men. The texts published at the time reveal changes and continuities in the Catholic discourse in its reference to "nature", understood in its biological materiality, as an unswerving fact of human reality, consisting in two sexes must unite under the "natural order". Gender theories are blamed by family disintegration, for providing support to new understandings of humanity, no longer based on bipolarity: men / women. A non extensive dossier of these texts formed the basis for the proposed analyzes. (shrink)
